Executive And Regulatory Agencies

Independent agencies exist outside the federal executive departments and the Executive Office of the President.:6 There is a further distinction between independent executive agencies and independent regulatory agencies, which have been assigned rulemaking responsibilities or authorities by Congress. The Paperwork Reduction Act lists 19 enumerated “independent regulatory agencies”, such as the Securities and Exchange Commission, the Federal Reserve, the Commodity Futures Trading Commission, the Federal Deposit Insurance Corporation, and the Consumer Financial Protection Bureau. Generally, the heads of independent regulatory agencies can only be removed for cause, but Cabinet members and heads of independent executive agencies, such as the head of the Environmental Protection Agency, serve “at the pleasure of the president” and can be removed without cause.

The degree to which the President has the power to use executive orders to set policy for independent executive agencies is disputed. Many orders specifically exempt independent agencies, but some do not.Executive Order 12866 has been a particular matter of controversy it requires cost-benefit analysis for certain regulatory actions.

History Of The Social Security Administration

The Social Security Board was created in 1935 when President Franklin D. Roosevelt signed the Social Security Act into law. The SSA has since gone through numerous name changes and operational revisions under different presidential administrations. The SSA was part of the Department of Health and Human Services until 1994, when it regained its original status as an independent agency.

In July 2021, President Biden fired SSA commissioner Andrew Saul and appointed Kilolo Kijakazi, deputy commissioner for retirement and disability policy at the SSA, as acting commissioner. Saul was criticized for efforts to reduce access to disability benefits, delays in providing the information needed to issue stimulus payments, and clashing with employee unions over COVID-19 safety protocols, including remote work.

While the SSA is an independent agency and Saul’s term was not due to expire until January 2025, two Supreme Court rulings have given presidents greater authority to remove appointees. One, in June 2020, determined that President Trump was free to fire the head of the Consumer Financial Protection Bureau , and a second, in June 2021, authorized President Biden to remove the chief of the Federal Housing Administration .

This paper examines the U.S. social insurance system, which we define broadly to include both programs supported by dedicated taxes and other federal programs that provide income support, assistance in meeting basic needs, or services to improve economic opportunity. The paper considers the social insurance system as a whole as well as its component parts, providing an overview of major federal programs in the areas of education and workforce development, health, income support, nutrition, and housing. The paper covers how the social insurance system is organized, how eligibility is determined and who benefits, how the benefits and services are delivered, and how the system affects poverty and inequality. We focus primarily on the system as it operated prior to the onset of the COVID-19 pandemic, but also look at how various programs respond to economic downturns. Coming at a time when policymakers will start shifting their focus from using the social insurance system to provide relief from the pandemic and recession to considering what changes should be made in the system on an ongoing basis, the paper also reprises an array of proposals to strengthen the system in various ways that The Hamilton Project has commissioned in recent years.

Old Age Survivors And Disability

SSA administers the retirement, survivors, and disabled social insurance programs, which can provide monthly benefits to aged or disabled workers, their spouses and children, and to the survivors of insured workers.
