The 1st step to finding land is to ensure the land is available.

Use the Yukon Lands Viewer to identify available land. Ensure that all the appropriate layers are turned on, including:

  • Settlement Lands
  • other dispositions, licenses, lease and administrative holds
  • local area plans and
  • key wildlife and environmental sensitive areas.
  • Also ensure you have a plan to access the land. Access must generally be within 1 kilometre of a maintained road and must not overlap any other:

    • titled parcel
    • Settlement Land or
    • conflicting use.

If the lands are free of any of these overlaps above, visit us at the Agriculture Branch so we can further investigate the area. We can also give you a tutorial if you need help using the Yukon Lands Viewer. Phone 867-667-5838 or email to set up a meeting. We are located at 320-300 Main Street in Whitehorse. We are open Monday through Friday from 8:30 a.m. to 4:30 p.m.

What Are The Other Potential Impacts Of Property Seizure

Having part or all of your property seized can result in tax implications if you’re required to pay capital gains tax on the compensation you receive. Likewise, you may have to pay compensation to tenants if you rented out property that was seized through eminent domain. If you’re a renter, you may be displaced from your home which could affect you financially if you’re unable to find replacement housing at a similar price. On a larger scale, eminent domain can be abused if a property is seized without compensation being provided.

    In Case Of Disagreement

We encourage both leaseholders and recreational users to show respect for each other and the land. If there is a disagreement between the leaseholder and the recreational user, either party may contact the rangeland agrologist at the local Lands office.

The agrologist will then discuss the concern with both the leaseholder and the recreational user to find a solution. Often this type of communication and/or mediation can help to resolve the majority of issues. If an informal resolution cannot be reached, a formal dispute resolution process is available to both parties through a local settlement officer. To find your local agrologist, see Land Management Contacts.

    What Is The Homestead Act

Back in the 1800s, the California Gold Rush corridor was in full swing and western expansion in the United States was a hot commodity for some with a single-family life or as an individual. To increase the rush of people moving west, the Homestead Act of 1862 was put into effect to give free land to anyone who was willing to move west and live on that land for at least five years.

Up to 160 acres of land was given to the western settlers wanting to start a life, and even modern-day wildlife management areas were up to play.

The last-ever claim handed out was in 1988 in Alaska, and since then, its been impossible to get land homesteaded to you from the federal government.

Some towns and small cities, however, offer its land in exchange for the creation of jobs or other needs in the community.

However, many municipalities are offering government land for leasing specifically to small-scale and local farmers. There are a series of government programs that range from municipal to federal levels that offer small plots of government land for agricultural development.

What Eminent Domain Means For Landowners

Federal restrictions severely limit public lands access ...

To understand what eminent domain means for landowners, it helps to understand what it means to hold property rights. Broadly speaking, property rights refers to theoretical and legal ownership of resources and how those resources can be used. When you’re discussing eminent domain, the term property rights is used in the context of land or buildings. Someone who has property rights can do what they like with the property with regard to how it’s used .

The government doesn’t have free rein to take someone’s property, however. The Fifth Amendment to the Constitution states that nor shall private property be taken for public use, without just compensation. Just compensation means that a property cannot be seized unless the party whose property is taken is given full and adequate compensation for it in return.

As mentioned, the eminent domain process involves an appraisal of the property. Once the appraisal is determined, the government will make an offer to the property owner to purchase it. If the property owner accepts, they receive payment and the government assumes ownership of the land. If they choose not to accept, the process continues with condemnation proceedings. At this stage, the property owner may attempt to do one of two things:

    • Secure an independent valuation of the property if they believe the price offered by the government is unfair
    • Protest the seizure on the grounds that they disagree with what the property is intended to be used for
