How Do I Claim Property From A State After I Find It
There’s no federal system for claiming your property — the process will vary from state to state. And you do not need to be currently living in a state to claim your property, so check other places you’ve lived.
Most states use a system similar to an online shopping service, where you add a property to claim, and then “check out” by providing information such as your current address and Social Security number to verify your identity and prove you’re the rightful owner of the property.
Once you file your claim, the state may contact you by email for any further information it needs to process the claim. Some states will allow you to provide supporting documentation online, while others require it to be filed by mail. Your state may keep a small amount — in Kentucky, it’s $1 for any property over $10 — as a holding fee.
Most states do not have a deadline for claiming property, though some may auction it off after a set period of time. If so, you will still usually have the right to claim its value from the state.

Why Would A State Be Holding Onto My Property Anyway
After a specific “dormancy period” — usually one to three years — businesses will send money and property to state-run unclaimed property offices when they can’t locate the owner. The state will then hold these items until their owner claims them.
The property can be money in a savings or checking account, stocks, annuities, life insurance policies or the contents of safe deposit boxes, among many possible items. Missing Money From Employers
Many people out there may find unclaimed money from previous employers. This could be from unpaid wages due to payroll checks never being cashed, overtime work that didnt get included in your wages, pensions or retirement plans that were never cashed out, or a refund of overpaid benefits.
To aid in helping connect former employees with missing funds, the Department of Labor has issued new guidelines to businesses to help them be more proactive in contacting past employees. This is due to a recent finding that most businesses werent in compliance with the Employee Retirement Income Security Act of 1974 , which mandates that plan fiduciaries must make every effort to locate missing plan participants.
If you feel youre still owed money from a former employer, the first step is to search for your employer through the Wage and Hour Division website. This resource, called Workers Owed Wages , is a free service run through the DOL that holds onto wages of former employees for up to three years.
If you are unsuccessful in locating your employer or having your earnings returned to you, you can file a complaint with the DOL for help reclaiming your benefits. To do this youll need to enter basic personal information about you and your employer. In some cases, youll also need to provide information about your past wages and how you were paid.
What Is The Federal Minimum Wage And What Are Overtime Rules
The federal minimum wage is $7.25 per hour. A state or city may have a higher minimum wage rate and, in a situation where an employee is covered by both federal and state wage laws, the employee may qualify for the higher minimum wage. Check with your state labor agency for more.
Employees covered under the federal overtime regulations should receive 1.5 times their regular rate of pay after working 40 hours in a work week. Note that the federal regulations do not require overtime pay for weekends or holidays unless working on those days exceeds 40 hours in a work week. Note that state laws may define overtime differently. California, for example, requires overtime pay after an 8-hour work day.

To see if you have unclaimed funds, search each states comptroller website . This is the governmental institution that handles the process. From there, each state will vary in its exact process, but youll likely be asked to type in your name, which will then generate a list of results. If the information seems like it could be yours based on an address match, for example, then you can say you want to claim it.
This is where youll have to plug in that personal information to prove your identity. Why Is The Labor Department Holding My Back Pay
If the Labor Department’s Wage and Hour Division finds an employer has violated labor minimum wage and overtime laws covered under the Fair Labor Standards Act, it attempts to recover those unpaid wages by making the employer pay the full amount it owes you.
If the agency couldn’t contact you, it holds your back wages for three years. After that, it’s required by law to send the money to the US Treasury. You won’t be able to claim back pay after that time.
