What Has The Federal Government Done To Address The Confusion And Complaints

Impelled by the rising number of complaints, CMS released new marketing rules that took effect in October 2022. The rules build on existing regulations that have evolved over years. CMS has proposed additional rules to further address complaints and beneficiary confusion including drawing greater distinction between education and marketing done by plans restricting the use of the name Medicare in product labeling and marketing restricting the use of superlatives like best or most and prohibiting ads that dont use a specific plan name.

Rules for insurers. The CMS rules are designed to prevent Medicare private plans from presenting misleading information about a plans costs or benefits. Only plans with the highest ratings can be marketed all year. All other plans may contact beneficiaries about plan offerings only from October 1 through the end of Medicares open enrollment period on December 7, and during Medicare Advantages open enrollment period for current enrollees .

CMS makes a distinction between communications and marketing materials. Marketing is considered information intended to influence beneficiaries decisions: details about benefits, premiums, and cost sharing star ratings, rankings, and measurements and how one plan compares to another. Communications materials do not provide this type of information. Plans are required to submit their marketing materials to CMS for review, though they are not required to do so for communications materials.

When Will The Pandemic Pause On Payments End

For the third consecutive time, federal student loan borrowers begin a new year without having to make payments on their loans thanks to a pandemic-related pause.

Payments were set to resume in January, but the Biden administration extended the pause after its student loan forgiveness program was halted by federal courts. Officials had told borrowers debt relief would be granted before payments restarted.

The payment pause will now last until 60 days after litigation over Bidens student loan forgiveness program is resolved. If the program has not been implemented and the litigation has not been resolved by June 30, payments will resume 60 days after that.

Borrower balances have effectively been frozen since March 2020, with no payments required on most federal student loans. During this time, interest has stopped adding up and collections on defaulted debt have also been on hold.

For some borrowers, the pause on payments delivers an even bigger benefit than Bidens forgiveness program ever could.

The yearslong pause cost the government $155 billion through the end of 2022, according to an estimate from the Committee for a Responsible Federal Budget.

Uniformity Standards Relaxed By Trump Cms

Both BMA proposals have merit, said David Lipschutz, associate director of the Center for Medicare Advocacy. But they dont negate the need to clarify and standardize MA plan benefits, he said.

During the Trump administration, the CMS relaxed uniformity standards that once required MA plans to offer the same benefits at the same cost-sharing for all enrollees in a plans service area, Lipschutz said. The agency also weakened meaningful difference rules that required MA plans to make their offerings distinguishable from one another, Lipschutz added. And Congress contributed to beneficiaries confusion by allowing MA plans to make supplemental benefits available to some, but not all beneficiaries, Lipschutz said.
