Welcome to the Small Business Procurement Power Page, designed by the U.S. Department of Labor’s Office of Small and Disadvantaged Business Utilization . OSDBU is responsible for promoting procurement opportunities for small businesses in compliance with federal laws, regulations, and policies. Are You Qualified For A Small Business Set

The SBA considers different factors to determine whether your business can be regarded as a small business. These factors vary depending on your industry, but usually, your business size is the crucial factor.

To determine whether your business is qualified for a small business certification, you can use this Size Standards Tool by SBA. To use this tool, input your NAICS codes and state your number of employees working for you full-time and part-time.

Furthermore, the SBA also has different contracting assistance programs to help small businesses in certain socio-economic classes.

What are SBAs government contracting assistance programs?

The government recognizes that not all small business leaders have equal opportunities. And that is why government agencies give preferential consideration in evaluating bids of small disadvantaged businesses that qualify for SBAs small business programs.

So to ensure that your small business has access to every opportunity available, here are some of the government contracting assistance programs you should be aware of:

Women-owned small business

For industries where women-owned small businesses are discriminated, the government sets aside specific contracts. Furthermore, the federal administration tightened the restrictions on some contracts to give economically disadvantaged women-owned small businesses better chances of winning federal contracts.

The federal government has more than 4,300 websites, according to a recent GAO report. Fortunately, if youre looking for contract opportunities, you dont have to cover all of those sites.

In order to help companies identify government opportunities and buyers, the government is making a strong effort to reduce the number of locations and to create a more uniform format to simplify the process. The government is looking to establish gateways to make your search easier. There are several already in existence that are being used more and more to post and find opportunities.

Following is a list of the better ones. Remember that these sites will help you find the opportunities, but once you do, you, not the government, will have to do the work.

Natural Resource Sales Assistance Program

In addition to the billions of dollars spent purchasing goods and services, the federal government also sells large amounts of natural resources and surplus property. The SBA Natural Resource Sales Assistance Program sets aside a percentage of these goods for bidding by small businesses only. In addition, federal agencies sometimes divide surplus materials into smaller parcels, making it easier for small businesses to purchase. The five categories are:

  • Timber and related forest products.
  • Strategic materials.
  • Leases involving rights to minerals, coil, oil and gas.
  • Surplus real and personal property.

The program also provides training for small businesses on government sales and leasing.

Types Of Government Contracts

Government contracting officers offer many different types of government contracts. These certain contracts come with a different exploit that can take a small disadvantaged business to great advantage.

Applicability.

This section applies to small business set-asides above the simplified acquisition threshold and orders issued directly to a small business in accordance with 19.504 above the simplified acquisition threshold.

This section applies, regardless of dollar value, to the following awards under subparts 19.8, 19.13, 19.14, and 19.15:

Contracts that are set aside.

Contracts that are awarded on a sole-source basis.

Orders that are set-aside as described in 8.405-5 and 16.505.

Orders that are issued directly in accordance with 19.504.

Contracts that use the HUBZone price evaluation preference to award to a HUBZone small business concern unless the concern waived the evaluation preference.

Limitations on subcontracting. A small business concern subject to the limitations on subcontracting is required to comply with the following:

For a contract or order assigned a North American Industry Classification System code for services , the concern will not pay more than 50 percent of the amount paid by the Government for contract performance to subcontractors that are not similarly situated entities. Any work that a similarly situated entity further subcontracts will count towards the concern‘s 50 percent subcontract amount that cannot be exceeded. When a contract includes both services and supplies, the 50 percent limitation shall apply only to the service portion of the contract.

Us Small Business Administrations Government Contracting Program

The Government Contracting Program of SBA ensures that small businesses receive their fair share of federal contracts. SBAâs programs include the establishment of small business set-asides, certification of small businesses to perform on federal contracts, and opportunities in subcontracting to large business prime contractors.

The Government Contracting Program of SBA works to make sure small businesses get at least 23% of all federal contracting dollars.

Additionally, the government tries to award a certain percentage of all federal prime contracting dollars to small businesses each year called Set-asides, that meet certain socio-economic conditions. They include Minority-owned, Women-owned, Service-disabled veteran-owned, and HUBZone-certified small businesses.

    Broader Public Sector Procurement Directive

    The BPS Procurement Directive supports and helps improve supply chain activities at Ontarios broader public sector organizations.

    The BPS Procurement Directive requires designated broader public sector organizations to:

    • acquire publicly funded goods and services, including construction, consulting services and information technology, through a process that is open, fair and transparent
    • establish clear lines of accountability for delegation of authority and procurement approvals.

    The BPS Procurement Directive is based on the principles of:

    • quality service delivery
    • process standardization

    It includes a protocol of conduct and compliance measures in the Supply Chain Code of Ethics and Procurement Policies and Procedures.

    What Qualifies As A Small Business For Government Contracts

    Federal Acquisition Regulation

    To be eligible for federal contracts as a small business, a company must be certified as meeting the Small Business Administrations business size standards. Depending on the SBA contracting program, the certification process may differ.

    Self-certification is possible for some small businesses by updating their small business profile in the official government organization called System for Award Management .

    Small businesses must also apply for certification for additional programs that require information about the small business, its ownership, and supporting documentation.

    Protesting A Firms Status As An Economically Disadvantaged Women

    Definition. Interested party, as used in this section, has the meaning given in 13 CFR 127.102.

    For sole source acquisitions, the contracting officer or SBA may protest the offerors status as an economically disadvantaged women-owned small business concern or as a WOSB concern eligible under the WOSB Program. For all other acquisitions, an interested party may protest the apparent successful offerors EDWOSB or WOSB status.

    SBAs protest regulations are found in subpart F “Protests” at 13 CFR 127.600 through 127.605.

    Protests relating to small business size status are subject to the procedures of 19.302. An interested party seeking to protest both the small business size and WOSB or EDWOSB status of an apparent successful offerorshall file two separate protests.

    All protests shall be in writing and must state all specific grounds for the protest.

    SBA will consider protests challenging the status of a concern if-

    The protest presents evidence that the concern is not at least 51 percent owned and controlled by one or more women who are United States citizens or

    The protest presents evidence that the concern is not at least 51 percent owned and controlled by one or more economically disadvantaged women who are United States citizens, when it is in connection with an EDWOSB contract.

    Assertions that a protested concern is not an EDWOSB or WOSB concern eligible under the WOSB Program, without setting forth specific facts or allegations, will not be considered by SBA ).

    Small Business Federal Government Contracting Dollars Continue To Increase

    The U.S. Small Business Administration recently announced that, yet again, the federal government exceeded its small business contracting goal by awarding $145.7 billion dollars in federal prime contracts 26.01% of the governments total procurement spending to small businesses last year, with at least an additional $82.8 billion in small business subcontracts. The SBA released statistics in its FY 2020 Small Business Procurement Scorecard, available here. Notably, while small business contracting increased $13 billion in prime contracts, small business subcontracting may have by an estimated $7.9 billion. Other Scorecard highlights include that the U.S. government exceeded the service-disabled veteran-owned small business goal of 3% and far-exceeded the small disadvantaged business goal of 5%. The government failed, however, to meet the women-owned small business goal of 5% and the HUBZone goal of 3%.
