Veterans Small Business Enhancement Act

In March 2021, the Small Business Administration released a Memorandum of Agreement between the SBA, U.S. General Services Administration and the Department of Enterprise Services Surplus Operations program to implement the Veterans Small Business Enhancement Act of 2018. The act enables eligible veteran owners of small businesses to participate in the Federal Personal Property Program.

Law Enforcement Support Program

The National Defense Authorization Act authorizes the Secretary of Defense to transfer excess Department of Defense personal property to federal, state, and local law enforcement agencies.

The Department of Enterprise Services is the authorized coordinator that operates the Law Enforcement Support Office Program in Washington state. DES reviews and approves requests for surplus military property and tracks the equipment once it is transferred to law enforcement agencies as is stated in the Memorandum of Agreement between DES and the Defense Logistics Agency.

Among our responsibilities is certification of those government agencies whose primary function is:

  • Enforcing applicable federal, state, and local laws and
  • Whose compensated officers have powers of arrest and apprehension

GSA sells used personal property according to the U.S. Government’s Standard Form 114C April 2001, “General Sale Terms and Conditions.” You may ask to review a copy from any of the GSA regional Sales Offices. Please study the terms and conditions in the Invitation for Bid and in any notices provided at auctions and other sales. Be sure you understand any special terms.

Clark County to hold surplus auction

State of Idaho property, with some exceptions, is disposed of through the Idaho Department of Lands, pursuant to Idaho Code §§ 58-331 and 58-332. If a state agency has identified the real property as surplus to their needs, it is appraised, presented to the Land Board for approval, and offered to state government and tax supported agencies for potential sale. If there is no interest from a government or tax supported agency, it can be offered for sale to the public.

Upon final approval to sell the property, an auction date is scheduled. The property is advertised for four weeks prior to the auction. An oral auction is then conducted in the location designated in the legal notice. The appraised value of the property establishes the minimum bid at the public auction. The property is sold to the qualified bidder submitting the highest bid. If the property does not sell at public auction, the Land Board may have the property appraised and enter into negotiations with any party.

How To Purchase Surplus Property

Surplus Property is property the government does not need. Personal property includes assets ranging from office equipment and furniture to scientific equipment, heavy machinery, airplanes, vessels, and vehicles. If this property cannot be donated to a state or public agency, or nonprofit organization, the general public can buy it.

You can purchase surplus government property through GSA AuctionsSM. The site offers the general public the chance to bid electronically on federal assets. All registered participants can bid on a single item or multiple items within specified time frames.

When no federal agencies need real property, it is determined to be surplus and may be made available for other uses through public benefit conveyances, including homeless use, negotiated sales, or public sales, based on GSA’s determination of the propertys highest and best use.

Or you can visit the Personal Property Sales by Geographical Location, which offers scheduled sales by geographic location and sales method. For sales methods, non-Internet includes live auction, fixed price, drop-by, negotiated sealed bid, and spot bid.

Tips For Participating In Government Auctions

  • The general rule for auctions is that the highest bidder wins, and cancellation is not possible. Check with the auction site ahead of time to find out if you can cancel a bid.

  • Each auction website operates differently. In some cases, the government agency itself runs the auctions. In other cases, the agency operates the shopping site, but a third-party company handles the auction itself.

  • Find out what forms of payment auctions accept. There is no uniform payment policy across all the different auctions. Some auctions accept credit card payments or personal checks. Others, such as the Internal Revenue Service , dont accept either of these. Most auctions accept cashiers checks.

  • For real estate auctions, you may need to work with a broker or real estate agent to bid or make the purchase. Also, for real estate auctions, find out if financing is permitted. Many times it is not and the full purchase price is due when you win the bid.

The Government of District of Columbia manages the sale of its surplus assets through online auction sales on dcgovt.govdeals.com. The program is managed by the DC Office of Contracting and Procurement , Surplus Property Division, and brings the District a streamlined process that creates a valuable revenue stream and meets the District’s criteria for transparent tracking and real-time reporting on transactions involving surplus property. Online auction items include items such as:

  • Passenger cars and trucks
  • Police, Fire and EMS vehicles
  • Computers and electronic equipment
  • Office furniture and supplies and
  • Evidentiary items including jewelry, cars and other personal property.

The cash flow from the sale of the District’s surplus assets will be deposited directly back into the treasury and re-allocated to departments and programs within the government. The additional revenue will enable the District to more effectively address and meet the expectations of taxpayers.

Lewis County holds a continuous online surplus auction of declared surplus personal property. New listings are posted on an as needed basis. Personal property generally includes, furniture, computer equipment, food service equipment, and misc. items.

What Does Tax

Properties offered for auction at tax foreclosure sales, but not sold, are deeded to the County. These properties are called Tax-Title. They may still be purchased from the County through a process called a tax-title sale. A list of tax-title properties is available at the Treasurers Office. Tax-title properties are subject to the same risks as tax foreclosure properties. Check the Auctions page for sale dates and minimum bid lists.

How Is Tax

Purchasing tax-title and County-owned surplus property is done through public auction, or by private negotiation without a call for bids per RCW 36.35.150, and is called a tax-title sale. It can take 6 months or more to bring a property to sale.

An Application to Purchase County Property , along with a $150 deposit starts the process. Each property requires a separate form and deposit. You may, however, request that several properties be sold as a group.

The Treasurers Office schedules a meeting of the Whatcom County Property Management Committee to present all applications received. The committee makes a recommendation to retain or sell a property, either by public auction or private negotiation. If the committee recommends retaining the property, the applicants deposit will be refunded. If the committee recommends in favor of the sale, a resolution is drafted and submitted to the County Executive.

The County Executive usually forwards the resolution to the Whatcom County Council.

The Whatcom County Council sets a public hearing date and applicants are notified. At the hearing the Council approves or rejects the sale. If the sale is rejected, the applicants deposit is refunded.

If approved for sale by public auction, the Whatcom County Treasurer schedules the auction and the applicant is notified of the date, time and location. The auction is advertised in the local newspaper for 3 consecutive weeks.
