Happy New Year! We begin the new year with the watchwords that we expect will drive the procurement system and government operations through 2023 and beyond.

Cybersecurity

Cybersecurity is a fundamental requirement for government operations and the contractors that deliver mission support. The cyber threat from near-peer adversaries and other bad actors is an ever-present reality. In 2023 we will see several policy and procurement measures addressing cybersecurity. Among these measures, this spring we anticipate the public release of the Cybersecurity Maturity Model Certification DFARs rule. A threshold issue is whether it will be an interim or proposed rule. Of note, in 2022 the Coalition submitted comments on the CMMC Pre-decisional Draft Assessment Guide, which can be found here

Un: Cost Is New Obstacle To Oil Transfer From Yemen Tanker

UNITED NATIONS The rising cost of purchasing or leasing a vessel that can hold more than 1 million barrels of crude oil now in a rusting old tanker off the coast of war-torn Yemen is the latest obstacle to resolving the grave threat of massive environmental damage from a possible oil spill or explosion, the U.N. said Tuesday.

U.N. deputy spokesman Farhan Haq said the availability of very large crude oil tankers has decreased in the past six months, basically due to events having to do with the war in Ukraine.

He said just as the U.N. was finally gearing up its operation to transfer oil from the FSO Safer tanker, the cost of buying a very large crude oil carrier is now about 50% more than what was budgeted in the original U.N. plan, and the leasing cost has also increased.

So we have some additional expenses, and its a little bit harder finding the right ships, but were proceeding with the work, Haq said.

He said donors have generously pledged more than $84 million of the funding required, and additional funding from the private sector is expected soon.

Haq said more than $73 million of pledges has been disbursed and essential preparatory work has begun.

However, the key challenge at present is procurement of a very large crude carrier, Haq said. The U.N. cannot begin the emergency operation until it is certain that a safe crude carrier will be in place to take on the oil.

I was recently in Washington to participate in a panel discussion at the fall meeting of the Coalition for Government Procurement. CGP is an organization representing vendors of commercial products to the government, particularly but not only through the General Service Administration schedules, and the panel featured former Office of Federal Procurement Policy and GSA administrators discussing their experiences in government and reflecting on the current procurement environment.

Since I dont spend very much time these days interacting with vendors, I thought it might be interesting to buttonhole some vendors at the conference, ask a few questions, and write a blog post about what I had learned. I took advantage of a lengthy networking session to talk with 12 participants, all of whom worked for companies that sell their products or services to federal agencies.

To keep things short and sweet, and not impose on folks too much, I asked only three questions. Here is what I learned.

The Ciminelli Case Shows Legal Risks Forcontractors From Unclear Rules On Communications

A case pending before the Supreme Court demonstrates thatgovernment officials are not the only stakeholders who wouldbenefit from clearer rules and guidance surrounding permissiblecommunications during the procurement process.

The case involves whether the insertion of requirements thatfavored an individual’s company into a state Request forProposals for economic development projects constituted wirefraud under 18 U.S.C. § 1343. A board member of the nonprofitentity running the procurement allegedly conspired with Mr.Ciminelli to insert into the RFP requirementshavingheadquarters in Buffalo and 50 years of experiencethatfavored Mr. Ciminelli’s development company. Mr.Ciminelli’s company was selected as a preferred developer underthe RFP and went on to negotiate a construction contract worth $750million.

An amicus brief filed by the Associated GeneralContractors of America, Inc. summarized the case’s starkimplications for government contractor communications withgovernment officials:

The construction industry has a profoundinterest in the case before the Court as it presentsa real risk of broad-brush criminalization of thelongstanding practice whereby government contractingofficials routinelyconsult with members of the general contracting community prior tothe issuance of a Request forProposal or formal bidprocesses.

Coalition For Government Procurement Urges Gsa To Address Inflation Under Federal Contracts

Labor government has inherited a âdefence procurement messâ: Marles

The Coalition for Government Procurement has asked the General Services Administration about its plans to address inflation on government contracts.

Inflation is negatively impacting GSAs contractor and customer bases, limiting access to the commercial market and reducing competition at the task order level for customer agency product and/or service requirements, CGP President Roger Waldron wrote in a Feb. 9 letter to GSA.

The impact is especially significant on small businesses, including small-disadvantaged businesses, Waldron said in the letter addressed to Mark Lee, assistant commissioner at GSAs office of policy and compliance.

The coalition is calling on GSA to speed up efforts in developing a framework to streamline assessment, administration and implementation of price modifications under its programs to address the pricing squeeze facing Multiple Award Schedule contractors.

GSA should come up with a plan to streamline the Economic Price Adjustment process, according to the letter.

CGP is also inviting GSA to meet its coalition members through a listening session that would serve as a venue for the agency to discuss its considerations in creating the plan and for its members to share their challenges and experiences in the current economic environment.

– to cut the time it takes to get on schedule – to untangle the red tape and simplify the process – I encouraged more of you to jump in and get on schedule – and I asked for your help, support and ideas.

You came through for me, as I hope Ive come through for you. Weve still got some work ahead, but the signs of progress are all around:

behind the scenes, weve been working on a strategic plan that will successfully guide GSA into the future.

Multiple organizations representing hundreds of federalcontractors took the FAR Council up on its requests for information.Many praised the FAR Council for taking the initiative, but alsoexplained why inserting the FY16 NDAA’s language into the FARwould not achieve the statute’s or the FAR Council’s statedgoals.

Concerns raised included the following:

One fundamental concern cited by multiple commenters was thatacquisition officials frequently avoid communication with industrybecause of the risk that they might violate unclear rules relatedto exchanges with contractors, conflicts of interest, and/orprocurement integrity.

Professor Ralph C. Nash, Jr. submitted comments identifying thesame problem, and argued that the FAR Council was “Proposingthe Wrong Fix” because “Band Aids Don’t Work.”His comments criticized the lack of clarity in both FAR 15.201 andFAR 15.406, including that the FAR contains:

o clear distinction between clarifications and discussionswhich forces the CO to become familiar with a myriad of GovernmentAccountability Office and Court of Federal Claims decisionsproviding murky guidance on this distinction. Faced with thisdilemma, many, if not most, COs limit the communications in orderto avoid losing a protest. This response to a badly writtenregulation is completely rational and fully understandable.

    Changes to the Ontario Public Service Procurement Directive

    Effective September 1, 2020, amendments to the Ontario Public Service Procurement Directive establish new requirements regarding the use of Consultants and Senior Advisors in Government.

    Changes appear in the OPS PD Interim Measures and include:

    • New requirements for consulting services contracts to have a cost identified for each deliverable.
    • New requirements, for procurements over $5,000, for Ministries and agencies required to follow the OPS PD in full to:
      • Use the Procurement Lifecycle Checklist for consulting services procurements.
      • Use the Procurement Lifecycle Checklist, or similar OPS PD-compliant ministry tool, for goods and non-consulting procurements.

    An additional amendment to the Interim Measures includes the introduction of âgovernment entitiesâ to be consistent with the terminology in the Supply Chain Management Act.

    The Coalition For Government Procurement: Transactional Data Reporting: A Logical Step In The Evolution Of The Mas Program

    In 2016, the General Services Administration issued a final rule to amend the GSA Acquisition Regulation to require that vendors report transactional data from, among other things, GSA Schedules orders. This data includes purchasing information associated with orders for goods and services, like product descriptions, quantities purchased, and prices paid. At the time, GSA had experimented with collecting transactional data through some of its contracts and found it instrumental for improving competition, lowering pricing, and increasing transparency. Though many of us in industry had concerns about how this rule would be implemented, in the fullness of time, we have come to see that Transactional Data Reporting really represents the next logical step in the evolution of the MAS Program as that program responds to the dynamic commercial market

    Notwithstanding the benefits and efficiencies associated with the use of TDR, there are some stakeholders that have expressed concerns about its use. They worry about the reduction in the totality of information provided by contractors, and they question whether TDR will yield the lowest cost alternative to the government. Against the totality of circumstances, however, these concerns may be misplaced.
