The Legal History Of The Aid To Dependent Children Program

Linda Gordon, Professor of History, New York University and Felice Batlan, Professor of Law, Chicago Kent School of Law

This 1940 poster was part of trio highlighting the programs under the Social Security Act of 1935. This poster is a reminder that the Aid to Dependent Children program was an original program under Title IV of the Social Security Act, until it was repealed in 1996 as part of welfare reform.

Aid to Dependent Children or ADC was Title IV of the Social Security Act of 1935. At first it functioned mainly to provide federal grants to help the states maintain their mothers aid laws that had been passed in 40 states between 1910 and 1920. With the federal government providing 1/3 of costs, the program offered aid to poor parents, imagined at that time to be always female, caring for children without a husband.

Ironically, the casework provisions for supervision created an effect virtually opposite to the intention of the designers. A provision in the law that authorized ADC assistance only to suitable homes functioned, in the programs first three decades, to reduce the number of eligible children and, particularly, to inhibit coverage of illegitimate children and children of color. Local ADC policy frequently discontinued coverage during seasons when low-wage labor was short in fields or homes, thus forcing poor mothers into such labor.

Emergency Financial Assistance For Single Parents

Single mom by choice: TV personality Sayuri sparks controversy in Korea

Although everyone should make building an emergency fund a top priority, single parents often find the task extremely difficult. Yet without an emergency fund, a job loss or health problem can create a financial crisis that, in the worst cases, can lead to poor nutrition, eviction and possibly homelessness.

A variety of subprime lenders will lend you emergency cash, but be careful and review the terms such lenders might require. High interest rates, often in the 399% APR range, that frequently compound can make it very difficult to repay these loans. If you decide to pursue an emergency loan, you should have a plan for repaying it quickly.

Single parents should contact their state social services agency to learn more about programs that are available. As mentioned earlier, states administer various federal programs for single parents, so a state office or website is a good place to begin research. You can also visit a local library and ask a librarian for help tracking down relevant information. Churches and charities are also a good resource. They often have funds to aid families with emergencies and can offer suggestions that might guide you through a financial crisis.

Less Money To Aid The Poor But Greater Latitude Over Its Use

The Southwest has been a case study in why welfare should not have been turned into a block grant, experts say.

Nevada, for instance, saw a greater increase in numbers of poor children from 1997 to 2015 than any other state, and Arizona wasnt far behind at the same time, those states federal aid funds per poor child declined in value by more than 50% due to inflation and demographic changes, according to the Center on Budget and Policy Priorities.

As a tradeoff for providing states like these with a set amount of funding that would decline in value over time, the Clinton administration promised each state more flexibility over how it could use the dollars, unburdened by federal regulation. The implication was that with greater discretion as to how to address poverty, states would innovate and find ways to do more with less.

But the opposite has been true. Because of their shrinking blocks of funding, states have cut benefit amounts for the poor and set short time limits for receiving assistance. And with their greater flexibility, they have spent the federal money on programs unrelated to direct aid to poor mothers and children or have asked equally poor fathers to pay the government back.

Many low-income moms in New Mexico said they lasted just a few months receiving aid because of how often their benefits were cut for not responding quickly enough to a child support mailing or for not taking off work to attend a child support interview.
