Requesting Expungement And Destruction Of Certain Marijuana Conviction Records

Unlocks landmark challenge to the governments criminal records disclosure regime

State law permits individuals convicted of Penal Law sections 221.05 and 221.10 to ask the court where the conviction occurred to expunge and destroy their criminal history records related to these charges. Individuals seeking destruction of those conviction records must make a formal request through the state Office of Court Administration . Please visit the OCA website for more information about how to make this request.Please note: Convictions of Penal Law sections 221.05 and 221.10 have been sealed. This means that all of the arrest, court, prosecution and criminal history records related to those convictions are confidential and cannot be seen except under the following circumstances:

  • If an individual is applying for a job as a police or peace officer and,
  • If an individual is applying for a pistol permit.

Individuals who are satisfied with the confidentiality that record sealing already provides are not required to apply for expungement or destruction of conviction records.

Are Arrest Records Public

Yes. Public access to arrest records is a right in most states. However, the information could be limited based on court rules. For example, arrest records that are part of an ongoing investigation may be kept private if the court decides that the record could compromise individual privacy. While the record may not be available for viewing, members of the public maintain the right to request arrest information.

Background Check & Criminal History Information

The Wisconsin Department of Justice has implemented the use of a Wisconsin Unique Personal Identification Number that is assigned to individuals who have successfully challenged a criminal history record existing in the Wisconsin Criminal History Database. The WiUPIN may be included in the search data provided by a requestor and if included will be used in searching potential matching records, so that any arrest and/or conviction record successfully challenged will not be included in a public response. If someone has used your identity during an arrest, or if someone has a very similar name and date of birth as you, you can challenge the arrest and/or conviction record by completing and submitting the criminal history challenge form and checking the Mistaken Identity/False Match option. A set of fingerprints captured by a law enforcement agency must be submitted with your challenge for fingerprint comparison purposes. The Challenge Form can be downloaded from here: .

There is no charge from the Wisconsin Department of Justice for this service.

Fingerprint-supported records can be used to confirm whether or not a criminal record in the file belongs to a particular individual. Arrests without supporting fingerprints or related dispositions are not included in the criminal history database.

There are two types of Police Information Checks:

    What’s The Difference Between A Misdemeanor Vs Felony

    The definition varies with jurisdiction, but in most states, a felony is a crime that carries a sentence of more than one year in jail. Colloquially known as true crimes, most jurisdictions consider felony offenses as the most serious of offenses. Thus, persons convicted of felony charges typically serve a sentence in a correctional facility under the supervision of the state department of corrections or the Federal Bureau of Prisons if the felony is a federal crime.     A bench warrant is a court order that a judge issues for the arrest of a person who failed to appear in court. Defendants that are due to appear at trial must attend on the said date and time. Failure to do so without prior authorization will cause the presiding judge to deem the absent defendant in contempt of the court.

    Most employers will be able to see your criminal record. There are different laws put in place in various states that prevent employers from discriminating against people with criminal records.     An arrest warrant is a document signed by an authorized official of the state judiciary permitting the arrest of a named person. Generally, state laws prevent law enforcement officers from making forced entry to a residence or private property without reasonable suspicion of wrongdoing. The document permits law enforcement agents to arrest a person at a certain time of day and in a certain place, even if it means entering private property without suspicion of wrongdoing.

    Individuals or their lawyer can use the forms that follow to receive verification from the Division of Criminal Justice Services that a court-ordered seal as defined by state Criminal Procedure Law 160.59, 160.55, or 160.50 has been applied to their New York State Criminal History Record.

    • This form should be used by individuals who have applied for and received a court order seal related to a conviction that occurred more than 10 years ago.
    • This form should be used by individuals requesting verification of a seal related to a felony or misdemeanor arrest that resulted in a conviction to either a traffic infraction or violation.
    • This form should be used by individuals requesting verification of a seal related to an arrest that resulted in the termination of the criminal proceedings in their favor .

    Note: A copy of the signed court seal order must be mailed with the verification form.

    How To Read A Criminal Record

    You must carefully read the entire explanation and the Wisconsin Criminal History Record response in order to determine whether the record pertains to the individual whose identifying information was submitted to be searched. The response is based on a search using the name, date of birth and any other identifying data provided in the search request. The identifying data provided in the search request will be included on the cover page accompanying the search response.

    Each criminal history response will include important information about the response. You should thoroughly read the How to read a criminal record and the section provided with each criminal history record response to understand how the response relates to the identifying information submitted to be searched.

    The criminal history record response will include the date of the response, order number, and the identifying information that was submitted and used to conduct the search. Criminal history background search requests submitted in paper form will be returned by U.S. mail with a record attached or an indication of no record found.

    Other names used by the person identified who is the Master Name are listed in the Alias Names/Fraudulent Data section of the criminal history response. It is not uncommon for criminal offenders to use alias or fraudulent names and false dates of birth, sometimes known as identity theft.

    Mistaken Identity Or False Match

    If someone uses a name similar to your name or gives it as an alias when arrested, that name will be entered in the Wisconsin criminal history database. You may have been a victim of identity theft or your name may be very similar to the name of a person who has a criminal record. If a background check is requested on a name similar to your name, ALL names in the database, including aliases, are searched. The search response may return all of the convictions that belong to the person who used a name similar to your name.

    To clarify that you are not the subject of the criminal history reported in response to a search request, you may submit a Wisconsin Criminal History Challenge Form. See the section below for more information.

    What Can You Do After Being Convicted Of A Crime

    After being convicted, one can appeal to a higher court, serve their sentence, and try to reduce their sentence through good behavior. Appealing to a higher court will cause the next court up from the trial court to review the case without receiving any additional information.
