The Government Contracts Regulations

10.1.1 As required by Section 5 of the Government Contracts Regulations, the contracting authority is to solicit bids before any contract is entered into. Policy On Use Of Letter Of Credit

3.1 A letter of credit which is issued by a financial institution which is a member of the Canadian Payments Association, may be accepted by a contracting authority either to provide an incentive for entry into or performance of a contract, or to provide a source of funds to mitigate damages if the successful bidder fails to enter into or perform the contract.

3.2 An irrevocable letter of credit which is issued by a financial institution which is not a member of the Canadian Payments Association is acceptable provided it is confirmed by a financial institution that is a member of the Canadian Payments Association and is otherwise in compliance with this policy.

3.3 A revocable letter of credit is one that may be amended or cancelled by the Issuer at any moment and without prior notice to the Crown as beneficiary. The Crown shall only accept letters of credit that clearly specify that they areirrevocable or are deemed to be irrevocable pursuant to article 6 c) of the UCP.

3.4 A letter of credit described in this section may be accepted as an alternative to bid or contract security for all contracts.

3.5 A letter of credit shall:

  • state the face amount which may be drawn against it
  • state its expiry date
  • provide for sight payment to the Receiver General for Canada by way of the financial institutions draft against presentation of a written demand for payment signed by the authorized departmental representative identified in the letter of credit by his office

    The Top 100 Contractors Report is a list developed annually by the U.S. General Services Administration as part of its tracking of U.S. federal government procurement.

    In fiscal year 2005, the federal government aimed to source 23% of all subcontracts from small businesses with guidance from the Small Business Administration. The federal government was unable to meet this goal in 8 years until FY2013 when it subcontracted over $83 billion from small businesses.

    Fiscal year 2015 marked several historic achievements the federal government exceeded their overall goal of 23% by 2.75% resulting in $90.7 billion dollars awarded to small businesses, 5.05% of which went to women-owned small business , meeting the goal for the first time since it was implemented in 1996.

    8.7.1 The WTO-AGP is a multilateral agreement that aims to secure greater international competition for government procurement. The WTO-AGP came into effect on January 1, 1996. Member countries include Canada, the European Communities, the United States, Japan, Korea, Israel, Norway and Switzerland. The WTO-AGP replaces the General Agreement on Tariffs and Trade Government Procurement Code by extending the previous coverage of goods to include services and construction. The national treatment and non-discrimination provisions and procurement procedures of the WTO-AGP are similar to those of NAFTA.

    Emails Emerge Of Vip Route For Uk Covid Test Contracts

    Discussions between health department officials and testing consortium revealed during legal challenge

    Further evidence has emerged that the government operated a VIP fast-track process for favoured companies leading to accusations that ministers misled the public about billions of pounds of Covid-19 testing contracts.

    The Department of Health and Social Care has previously denied operating any VIP process for companies referred by ministers for possible Covid contracts. In June, when it emerged that civil servants had passed on referrals labelled fast track from ministers, a government spokesperson said: These claims are completely false there was no high priority lane for testing suppliers. All offers of testing went through the same robust assurance checks and there was no separate fast track process.

    However, internal emails between DHSC civil servants, discussing the Rapid Testing Consortium , a group of companies led by York-based Abingdon Health, which was awarded huge government contracts without a competitive tender, did describe the process as the VIP route. The then health minister, Lord Bethell, was described by officials as a sponsor of the consortium.

    In the email exchanges, one civil servant, discussing how to process the RTC companies, said a person in authority, whose name is redacted, would like them to go through the VIP route. The official asked: Who should they name as their sponsor?

    General Procedures For Soliciting Bids Or Awarding Contracts Estimated At $1000000 Or More

    2.1 Contracting authorities soliciting bids or awarding a goods contract or a service contract valued at $1,000,000 and above must:

  • indicate to bidders the FCP requirements
  • request and obtain from the bidder/supplier, as appropriate, the necessary evidence of compliance with the FCP, namely a valid and current Agreement to Implement Employment Equity duly signed by an authorized executive of the company or a valid Agreement to Implement Employment Equity number issued by ESDC-Labour
  • 2.2 Contracting authorities soliciting bids or awarding a goods contract or a service contract valued at $1,000,000 and above should:

  • verify the accuracy of the Agreement to Implement Employment Equity number by comparing it with the number listed for that organization/bidder in the FCP List of Certified Employers. ESDC-Labour makes this information available on Publiservice.
  • contact the Director of Workplace Equity or seek clarification from the bidder if the Agreement to Implement Employment Equity number cited by the bidder does not match the Agreement to Implement Employment Equity number listed on the FCP List of Certified Employers.
  • confirm whether the FCP applies to suppliers by consulting ESDC-Labour’s internet site or by contacting ESDC-Labour, or by consulting the Act. A supplier is not subject to the FCP if it is covered under the Act and therefore falls under federal jurisdiction.
  • provide bidders with a standard Agreement to Implement Employment Equity, available from ESDC-Labour.

    Over the past two years, thousands of tech company employees have taken a stand: they do not want their labor and technical expertise to be used for projects with the military or law enforcement agencies.

    Tech Inquiry’s research was led by Jack Poulson, a former Google research scientist who quit the company in 2018 after months of internal campaigning to get clarity about plans to deploy a censored version of its search engine in China called Project Dragonfly. Poulson has publicly opposed collaborations between American technology companies and the U.S. and foreign governments that aid in efforts to track immigrants, dissenters, and bolster military activity.

  • The requirements of Part II “General Conditions”, section 13.1 of the Employment Standards Act of the Province of Ontario, apply to employers who, on or after October 31, 1995, begin to provide building services such as cleaning, catering or security at the premises, replacing another employer who was providing those services.
