Background The Federal Contractors Program For Employment Equity
The Federal Contractors Program for Employment Equity was implemented October 1, 1986 following the proclamation of the Employment Equity Act on August 13, 1986. The Act itself covered private sector federally regulated enterprises with 100 or more employees and required them to implement employment equity. The FCP targets non federally regulated federal contractors with a resident workforce in Canada of 100 or more employees which received federal contracts for goods and services of $1,000,000 or more.
The Act was amended in 1995 to strengthen various provisions and to provide measures to ensure compliance with employment equity requirements it also extended the obligation to implement employment equity to federal departments and agencies. The Act states it is the responsibility of the Minister of Labour to “administer the Federal Contractors Program for Employment Equity.” This legislative mention clearly authorizes the Minister of Labour to develop procedures necessary to administer the Program and ensure that contractors comply with their employment equity obligations.

What Is The Difference Between Partner And Contractor
A partnership is a business association formed by two or more people who go into business together. Partnerships are governed by state laws and legal implications. Some states permit different types of partnerships, such as limited partnerships, though these agreements must be registered in order to be formed.
Partnerships are built on trust and care, which leads to continuous delivery and true alignment with your goals as an individual and as a company. Partners dont just come in for the day and leave they take the time to understand where your business is going.
On the other hand, a government contractor is a private corporation that manufactures items and provides services to government organizations. Contractors are hired by government contracting officers after obtaining open-bid contracts.
In other words, a prime contractor or a contractor is someone who is required to participate in projects or contract opportunities. They might be a supplier, borrower, lender, buyer, vendor, and so on.

Find The Best Option For Your Needs
First, we will look at how you can find the contracts that youre interested in. Then we will explain how to bid on a government contract with step-by-step instructions.
Federal government contracts are published on the FedBizOpps website. If you want to pursue contracts at the federal level, you can register your business with FedBizOpps to receive notifications about new opportunities that align well with your business.
Finding suitable contracts at the state, county, regional and municipal levels can be much more time-consuming for small and medium sized vendors. With thousands of Requests for Proposal , Requests for Quote and Invitations for Bid being published across the U.S. every day, it can be difficult to keep up with them all.
In order to find opportunities in these jurisdictions, you will need to visit state bidding portals, municipal administration websites, and county purchasing departments. Most of these portals require you to complete a registration process.
If your business employs a person dedicated solely to researching contract opportunities, the do-it-yourself method can work for you. Keep in mind, however, that the time required to evaluate if a contract is right for your business can lead to spending a lot of resources on research and evaluation, instead of bidding on contracts.

How Can An Attorney Help You Obtain Federal Government Contracts
As with any contract, a federal government contract is a legally binding agreement between you and a federal agency. Before contracting with the federal government, you should have your attorney review the contract carefully to explain all the terms and conditions, including any terms that might not be fair or equitable for your company. Besides reviewing potential contracts, an attorney can also help you prepare proposals for potential contracts, assist in resolving disputes regarding contracts, advise you of the laws and procedures regarding government contracts, and handle any other legal matters or claims which might arise during the job.
Before contracting with the federal government, you should have your attorney review the contract carefully to explain all the terms and conditions, including any terms that might not be fair or equitable for your company.
Working with the federal government can be very lucrative, but it can also be complicated and overwhelming if you do not understand the process. A lawyer can also provide compliance counseling, which reduces the risk of time-consuming and expensive legal issues. Your legal counsel also helps you protect your intellectual property and trade secrets when working with a federal government agency.
Contractual Arrangements Involving Crown Corporations
12.10.1 Subsection 41 of the Financial Administration Act states that the Government Contracts Regulations do not apply to federal or provincial Crown corporations unless the legislation of the Crown corporation specifically requires that it be subject to Subsection 41 of the Act. Consequently, the Treasury Board Contracts Directive and relevant policies do not apply to Crown corporations. Arrangements between departments and Crown corporations cannot be contracts in a strictly legal sense .
12.10.3 Agency status. When a department or agency has been designated as an “agent” of a Crown corporation, the contracting procedures and authority limits of the contracting authority continue to apply. As stated in article 4.2, Related requirements, the contracting authority cannot assume the powers of a Crown Corporation even when undertaking work on its behalf. In practice, the department or the Crown corporation will seek Treasury Board authority when a proposed contract exceeds the limits prescribed in the Contracts Directive.
